Unlike non-Indian Fee lands, acquisition of Leases on Indian lands must follow specific process to comply with Federal regulations.

Congress promulgated a specific set of Rules governing the leasing of lands belonging to Restricted Members of the Cherokee, Chickasaw, Choctaw, Creek and Seminole Nation. One must be mindful of various requirements imposed by the Dawes Act, Stigler Act and other Congressional actions and court decisions that govern the acquisition of leases (and minerals) within the jurisdictions of these five tribes of Oklahoma.

A&A is well versed and has secured lease approvals from various Bureau of Indian Affairs agencies in Oklahoma.

The Mineral Leasing Act authorizes the Secretary of the Interior to lease and enter into various agreements for the development of oil, gas, and other minerals on federal lands. A&A assists various clients with the acquisition, transfer and maintenance of leasehold and other types interests on federal lands.

Communitization Agreements are used when operators cannot independently develop separate tracts due to well-spacing or well development programs. Otherwise stated, a Communitization Agreement is used when a unit as spaced by a state oil and gas regulatory body contains a mixture of fee and federal and/or tribal lands, or when several federal or Indian leases cannot be independently developed within a given unit.

The ONRR is tasked with receiving production (OGOR) and Revenue (ONRR/MMS- 2014) Reports each month and is authorized to audit and impose penalties for failure to comply with the Act.

A&A assists clients with registrations, reporting, and audits with the ONRR.

A&A assists clients in securing approvals of Applications for Permit to Drill (APD) on Bureau of Land Management (BLM), Bureau of Indian Affairs (BIA), United States Fish and Wildlife Services (USFS), Commissioner of the Land’s Office (CLO), United States Army Corps of Engineers (USACE), Department of Defense (DOD) lands.

A&A assists operators and lessees obtain and release bonds with the BIA, BLM, State and Local Governments.

A&A Assists clients with biological evaluations for Environmental Assessments (EA’s), Cultural Resource Surveys/Reviews and Environmental Impact Statements (EIS) as mandated by federal regulations.

Site security requirements ensure the proper and secure handling of production from Federal and Indian onshore oil and gas leases. The proper handling of production is essential to accurate measurement, proper reporting, and overall production accountability, and to ensure accurate measurement and reporting of onshore oil and gas production.

A&A conducts site reviews and designs and files Site Facility Diagrams to ensure compliance with Section 3173.

A&A ensures that all prospective assets comply with federal guidelines and that regulatory filings reflect all interest purported to be conveyed.

A&A ensures that our clients acquire properties they will immediately be able to operate under all applicable regulatory guidelines.

Mr. Anaback holds a Juris Doctorate from Oklahoma City University School of Law as well as a BBA in Energy Management and an MA in Managerial and Energy Economics, both from the University of Oklahoma. Mr. Anaback is admitted to practice law in Oklahoma. He is a Member of the Oklahoma Bar Association, the Oklahoma City Association of Professional Landmen, and the Tulsa Association of Professional Landmen.
